why does she still get incapacity benefit after it was proven that she isn't incapacitated?
That is probably up for review, though in the meantime she will still get it. Though that could be withdrawn, but if she has others who depend on her she might be entitled to another benefit such as attendance allowance. It is probably why she avoided gaol as well. Though there are rules about the maximum that can be deducted. She is probably paying the maximum, and might actually lose any inheritance as that could be seized as well.
