A court in Germany has ruled that Apple cannot get an immediate ban on the Samsung Galaxy Tab 10.1N (the one brought out to get around the original sales ban, back in October). The judge said that, in her opinion, Samsung had done enough and could continue to sell the 10.1N until the final decision at the end of January (Ober Landesgericht) and mid February (Landesgericht)
http://www.heise.de/mac-and-i/meldung/A ... 00249.htmlFor the case itself, Samsung have provided new evidence, in the form of a prototype touch device from 2003, which uses a similar form factor and icon based interface. If the court accepts the prototype from 2003, the Apple case will in all likelihood crumble, because the Apple iPad look-and-feel copyright will no longer be valid, due to prior art.
Edit: The part about the prototype was in the print edition of the magazine, which I got on Saturday. I couldn't find a link online, but there was a link in the article, I'll try and dig it out this evening.
