That's the joy of lab based testing compared to real world testing.
A standardised test should give you reproducible results that allow comparison between vehicles and brands. Unfortunately, it's open to rigging as has already been clearly demonstrated.

It's a symptom of a more fundamental principle : Corporations are utterly amoral and will happily break the law to make more profit if they think there's any chance at all they can get away with it. Expecting corporations to behave 'properly' is a fool's errand. They do so when and only when faced with diligent enforcement of the law and penalties that actually hurt.
