I'm not sure misuse of private information or the breach of the Data Protection act will be upheld. It's not Fb that misused her information, and as long as Fb complied with the take-down of the image when notified, it hasn't breached the Data Protection act. I think the only negligence that has taken place was by the girl, for letting the wrong person get hold of a naked photo of her in the first place.

Just to be clear, I agree, however I wanna see how it plays out legally as FB get away with a lot of sh1t whilst taking no real responsibility until the press come calling. And even then...

Why do I suspect she's suing Facebook rather than just the bloke because facebook have more money? I'm not sure what she thinks should have happened if Facebook took down the picture as soon as they knew about it. Certainly the bloke in question should be spending a lot of time at her majesty's pleasure.

Especially given the age of the girl. Distributing a nude image of her would be classed as disseminating child pornography. Mark

The report say she is suing both the man and Facebook. FB could simply add the fingerprint of the image to their banned list, then it can't be reposted. Likewise, as she is underage, surely this falls under child protection and paedophilia? In which case, they would be lucky to get away with not having the site banned...

Exactly. Why sue them as well when they took it down. I suspect they're included because they have lots of money. IMO the only person to blame is the one who uploaded it.
