In principle I'd agree but the record of English courts bringing the police to book for their actions is sadly very patchy. Anyway, as I said, I'm less interested in the likelihood of him getting prosecuted as I am in making sure he's never in that situation again because it could have turned out much worse than it did.

I am glad that the courts are looking at this case but since the burden of proof against the police seems immensely high at times.

I don't know if it actually got to a jury, did it? The judge said there wasn't sufficient evidence to suggest it wasn't justified, so the case couldn't go forward.

This is an interesting interpretation of the law - essentially a copper can now kick the c!*p out of you and it's up to you to show that legally he wasn't supposed to do so, rather than him proving he was justified in doing so. A thousand years of law overturned for one knob-jockey of a constable who can't control himself under pressure. Bloody marvelous.

I suspect an appeal may very well be in the offing, because that judgement is beyond ludicrous.

I doubt it. It was the CPS that screwed up the process. I would how ever expect a civil claim against the officer in question. That might have much more chance of success because it only has to be beyond reasonable doubt.

Aren't civil claims "on the balance of probabilities" and criminal "beyond reasonable doubt"

Without making any judgements, I've just watched the video a few times and it looks as though the situation had got tense already with the pushing of the black guy with (I think) a newspaper outside the cordon, but it looked as though the officer in question was walking away from the woman, into shot.

We can clearly see what's in her hand from behind her (camera angle) because it was cupped in her hand as she was gesturing but I wonder what it looked like from the front (his perspective)

I also wonder why, after he'd already back-slapped her, she followed him and carried on being agressive? It can't have been much of a slap since she's tiny in comparrison but barely even flinched, if an officer back-handed me I wouldn't go near him again, let alone get up in his face when he's already demonstrated his willingness to use force to get me away from him.

Lastly, just before he drew his baton, there seemed to be a surge of protestors towards him which I can imagine would look threatening, his decision was made in a split second, but it also doesn't look as though he did more than take a measured blow, certainly not the beating I was imagining from reading some of the reports.

IMO I don't have enough information to make a judgement, the fact that the lady didn't show up to testify speaks volumes to my mind, but given some of the bias against Police officers I've read about, even just in here, I'm not sure a jury of the public is much of a plan.
