I thought chip and pin was already shown to be flawed two years ago?

My thoughts were that if some had the PIN then it would be impossible to prove that you were not the one using the card. Though as has been demonstrated elsewhere if they shoulder surf or use a scanner to get the card details electronically then you are stuffed unless you are out of the country, and can prove it.
