I can both sides of this argument. But I cannot decide which side I stand. While Apple could be abusing their position I can understand why they have to do it.

This is a potential problem which could impact greatly on those who develop plug-ins for applications if this policy is carried over to the Mac App Store. At the moment, you can’t do in-app purchases on the Mac App Store, but you CAN use third party plug-ins sourced from places outside of Apple’s store. If Apple push this policy to Mac Apps too, then it’s going to cause problems for any plug-in developer whose parent app comes from there.

I develop add-on Actions for Softpress’ Freeway application, which so far is not available on the Mac App store, but no doubt they are planning a strategy to move some or all of their products there.

downloading anything from Sony would probable involve an added rootkit program
so i would sooner trust Apple in this department, but that trust only goes so far ...

I agree. So far Apple have done far more for consumers that than the rest. If they abuse that they could suffer considerably.
