Sorry, but A) the hacking sould be illegal, and B) the theft of someones download allowance certainly should be.

It is illegal, but they're saying it's a tort, rather than a criminal matter.

TBH I could go for that argument, it's effectively digital trespass.

"Theft" of data allowance is a much trickier matter, but I don't think it's provided for in UK theft legislation - again it would be a civil matter, recovering losses directly incurred by another party.
