 Dell and Acer won't be releasing Android 3.0 for their 7" tablets now. Allegedly, Google have now moved the goal posts and the Dell Streak 7 and the Acer Iconia A100 tablet no longer count as tablets in Google's book and the manufacturers won't be able to officially release Honeycomb for their devices. htc's Flyer should also be included, if it is a size thing, but it is rumoured, that htc will still be releasing Honeycomb for their Flyer tablet. This has caused some consternation and the idea, that it might be resolution based, not physical size. It is unclear as to whether the Samsung Galaxy Tab will be affected. They are stuck on 2.2 or 2.3 for now. Although xda-developers forum has release Honeystreak for the Dell, which is not official (and if Google aren't releasing the source code, is it complete?).

How to Google get away with that? As Android is Linux based, I thought they were obliged to release the source code as part of the license.

While not all of Android is Linux.
Parts of it are Google code, which they then open source when they feel like it.
