http://www.bbc.co.uk/news/uk-13957873 I think the courts have got this right TBH. I'll have to have a dig in my books for the research, but it's been shown before that the longer the Police have to investigate a case, the longer they will take. I'm not suggesting they're necessarily lazy, but the evidence is there to show that shorter timescales lead to speedier investigations and charges being brought. If the Police don't have enough to charge someone, then I don't see why anyone should have any restrictions placed upon them, until such time that the Police can bring charges. |

Witnesses are far better in the first couple of days as well so it could be a good thing. |

Would just like to address this while I'm at it:
Oh come off it! Re-arresting someone is hardly difficult. As for "requiring new evidence" - if you didn't have enough to charge them in the first place, then odds are you'll have new evidence when you re-arrest them because you'll have managed to piece a case together. ![]() I really don't see why the Police should be able to place restrictions on a person's liberty in the longer term, it's extrajudicial punishment IMO - especially if the Police 'NFA' the case further down the line. |

They can hold them for a few hours release them on bail and then charge them later, even after they get more evidence. You do not even have to arrest them again. You release them on police bail tell them to report at the police station at a future date and then when they come in announce whether they will be charged or the case is being dropped. No need for emergency legislation. |
