I would say that it was illegal in Europe because of consumer rights. I do hope that someone complains to the EU and let them sue Sony for illegal practices and slap them with a huge fine regardless. Even the hidden opt back in clause is not going to save them. They cannot force people to sign away their rights.

I am sure that under UK law you cannot sign away your rights as it would fall foul of the unfair contracts act

Probably; prima facie I would expect the Unfair Contract Terms Act 1977 to come into play here.
