That's usually the kind of crap they throw at people to discourage further action (or at least reduce the numbers).
I doubt it would stand the test.

And you can’t sue if thou have applied the latest update, as the T&Cs you agreed to forbid that kind of action. Mind you, that agreement’s legitimacy has not yet been tested in court. |

I was under the impression that the new T&C's attempted to prevent people joining class action lawsuits, you could still bring an individual case. I don't have a PS3 so I don't particularly care but I do hope someone in the EU goes round and kicks in the doors of Sony's legal department for attempting to pull this sort of thing. |
