Well a single photograph might look damning it might be dependant on want happened before or after. He could have simply been stretching his arms above his head and they might have immediately returned to the steering wheel, which he probably held stable with his knees for the three or less seconds he would have needed to carry out the manoeuvre. Still to do it with a police car behind is stupid.
