I mean if you're assuming the strict letter of the law, you'd also assume that's wrong if not illegal :? :|

In a statement issued before Naeem died, the Metropolitan police said: "Mr Naeem, a British national, was stabbed in Queen's Market, Green Street, E13 on 16 February. The victim remains at an east London hospital, however his injuries will prove fatal and consequently the three youths have been accused of murder."

If the person was going to die anyway, which in this case he did, what is the problem? If the doctors could not save the person then it does not really matter. All it would have been doing is saving the extra paperwork of upgrading an attempted murder charge to a murder charge.

It's a question of orders and probabilities. if you charge someone with murder then the 'victim' manages to stage an unlikely recovery, you've not just ended up with lost of egg on your face, you've given the defence lawyers in whatever trial you do finally get the accused up in a stick to beat you with.

Its a simple question - what do they have to gain by jumping the gun in this way? None as far as I can see. It's not as if they'll manage to work though charge-trial-conviction-sentence all while the guys hovering at death's door.
