Given you can now set Android for a password every time you make an in app purchase, I can't see many cases being successful in the future.

Previous examples have conclusively proved that 'You just set the option! It's there! You just flick the bloody switch!' is not enough to protect indolent parents from their children's stupidity, nor app store proprietors from said parents' opportunistic lawyers.
