I was going to say, that it would be a franchise and is not McDonalds itself, so surely the employees should be sueing the franchise holder himself, not McDonalds.
That said, if they had reported the cases to McDonalds the franchiser and they had taken no action, then there would be a case.
In Germany Burger King cancelled the licence for one of its franchise holders and over 180 restaurants in Germany were closed the next day and remained closed for a couple of weeks, until a new franchise holder was found.
The owner of the franchise had ignored health and safety and food hygene regulations and BK gave him some time to get his act together, no change, so they killed his franchise.

Yep, but they've got more chance of getting more money from the corporation than the franchise holder. That's how lawyers there think.
