The DoJ contends that emails should be treated as the business records of the company hosting them, by which definition only a search warrant would be needed in order to compel the provision of access to them no matter where they are stored. Microsoft argues the emails are the customers’ personal documents and a US warrant does not carry the authority needed to compel the company to hand it over.

That's before you even get to the muppets on the panel

It will be interesting to see if the judge holds Microsoft to be in contempt of court, as they have requested, then they have the chance of taking it to the supreme court. This has been going on for a couple of years now and as previously pointed out here, if Microsoft lose the case it will mean the end of international cloud businesses generally. Google, Apple, Microsoft, Amazon, Dropbox, Box etc. will only be available in the domestic USA market, every other country or region will have to come up with their own equivalents.

Even a representative of the Irish Government appearing in the court last year and telling the judge that he had no business making decisions affecting the sovereignty of Ireland didn't hold any sway in the matter.
