Last week, Judge Gaitan ordered Henderson to serve 24 months in federal prison along with 3 years probation for recording the movie. In addition he must pay $24,738 in fines – $19.95 for each of the pirate movies seized from his home.

In other words, we're making an example of you on behalf of a price-gouging industry

Quote:
“The theft of films by camcording is a serious threat to the health of the motion picture industry and the 2.4 million Americans it employs,” said Mike Robinson, Sr. Vice President of Content Protection at the MPAA. “This is an appropriate sentence for a very serious crime, and we hope it will serve as a warning to would-be movie thieves that they will face severe consequences for engaging in these activities.”

You're full of sh1t son, the movie ticket sales business is in rude health, even the utterly retarded films make a clean fortune now :x

Quote:
Despite all the efforts, The Dark Knight still leaked online in cam and other formats and went on to become the most-pirated movie of 2008 with 7,030,000 downloads on BitTorrent alone.

And yet somehow it's the second highest grossing film of all time... bloody internet, eh? :P

If he had walked into the cinema and punched a guy, what punishment would he have received?

This is one thing I have never understood.

They say that pirating movies is harming the industry yet year upon year the box office records are completely obliterated.

Also people who pirate movies (either by downloading or creating copies) on average spend more at the box office than the average Joe.

Surely they should just ignore it and reap the benefits of the bazillions of dollars they are getting instead of taking their bat and ball home over the few thousand that they miss out on because someone created a second rate copy.

If he had walked into a shop and stolen a copy of the DVD what punishment would he have received?

What if he had broken into a warehouse and stolen 1,240 DVDs?

For once (and I can't believe I'm about to say this) I agree with the MPAA. The guy's a thieving toe-rag.

I can't believe it either, but +1

Camcording is bollocks. He's [LIFTED] stupid and the sentence should reflect that stupidity. Anyone who wants to watch that quality is a numpty and anyone supplying that ridiculous need gets what they deserve. Of course he's being made an example of, but the guy was out to made a load of money that wasn't is. End of.

I wouldn't mind if there was consistency with jail terms in given countries but there just isn't, so I think this sentence is ridiculous in the grand scheme of things. It's even worse since it's obvious that this has more to do with lobbying than actual justice or perspective (something we're starting to see over here too).

Regarding him profiting from it, he's obviously in the wrong in doing it at all, but the people who were buying or downloading 'his' stuff were highly unlikely to ever go and buy it in the first place. I'm waiting for the day some p1ssed-off judge says that to an MPAA-style tw@...

People watching bad quality movies baffle me too, but the thinking must be 'I got it free/for next to nothing, so...'. And that just adds to my thinking on those sort of people never going to the cinema etc...

I wouldn't underestimate the social aspect of being able to say you'd seen a film before anyone else you knew either :)

I can't understand people actually buying such crudy DVD's. You can rent it for the same amount.

I can understand that aspect. With X Men Origins: Wolverine there was a huge element of that but I do not think that it harmed sales. The download was pre post production, so had lots missing. I would expect some went to see the differences between the download and final version.

Not if it's only hit the cinema though ;)

With Wolverine, I wouldn't be surprised if they knew they had a stinker on their hands and released the print themselves - maybe I'm mistaken, but entire workprints generally don't hit the net, even in this day and age of nosiness :?

As it was they drew a lot of media/net attention to a film that up until then had had nothing but bad press; (alleged) re-shoots and heavy post-production work, script being re-written on the fly and so on.

Oh, and my God did it show

I'm with Rusty and Okenobi.

The guy got what he deserved.

It would have been bad enough, if he had recorded it and shared it on P2P, but to sell a video record copy? [LIFTED]

I think the industry protests too much, sometimes, and goes after fairly harmless people, but in this case, they seem to have go the right guy.

I don't agree with jail terms for copyright infringement, which should in all cases be a civil infringement. By all means ban him from the cinema, sue him for damages etc, but a prison term is far too extreme.

Yes the guy is an idiot and he deserves it. Camcorder copies of films are a waste of time, no matter how new they are. I would rather wait for a DVD version. If the film is good enough people will buy a genuine copy, though again pricing is important.

The MPAA protest too much.

I agree.

People have served less time for far more serious crimes.

I would agree with the sentence if it was along the lines that LU stated.

Also there are millions of people in the UK who would be in prison for copyright infringement.
