It was inevitable after he failed to pay the fines. Though I hope that he realises 6 months inside as a smoking martyr will not really help his cred inside gaol. :o

TBH he knew he was breaking the law and the only reason he did it was because he didn't think he would go to jail. For this reason alone he is a moron.

You can choose to go outside and not pollute my airspace/hair/clothes etc with your filthy stench.

Freedom of choice for the smoker means no freedom of choice for non-smoking patrons of the establishment. If you want to smoke then you can go outside and a lot of pubs provide special facilities for you to do so if you wish.
If the ban on smoking inside had been brought in when a significant proportion of the population still smoked then it could be argued the other way. As it is smokers are now a minority of the population and their activities haven't been banned they've been redirected into a area where they are less likely to cause harm to others.

You can choose to go out side and be spared the risk of contact with smokers or go to another pub. :D

It should be down to teh business to decide to allow it or not. IMHO.

ps I am a non smoker but really have an issue with this.

No I couldn't. If there was no smoking ban, all pubs would be smoke filled. And I couldn't go outside a lot of the time as many in town pubs don't let you take drinks outside. Plus I'd have to breath in your smog while buying the drink in the first place.
