Also... if the guy knew that he was going to be scanned couldn't he have "thought some imaginative thoughts" for a few moments, just to get himself "a little more presentable"?

I disagree. His employers are hardly likely to have shouted the reason for the complaint from the rooftops, are they? It would have been treated as confidential. The only thing that surprises me is that, given that this happened in America, he didn't sue and get a sackload of cash.

What his employers may or may not have done, could well be irrelevant to him. He may not know employment law, or be educated as to the "proper" response to this situation. Regardless, the problem here is the scanner and the behaviour it has induced.
