I find it amazing that he didn't notice the initial impact or resistance as he was driving :?

She told him he could retain his LGV driving licence because he could not see, hear or smell the car.

Was that the tyres, or the driver's trousers?

If one is diving so close to the limits that +/- 1% will make a difference then the error has already been made.

Air conditioning would reduce incoming smells. That said she did undertake him and without due care and attention so she should have at least three points on her license. As the judge said he manage to drive to the hard shoulder and stop without further incident. A fair outcome.

Undertaking isn't an offence, so not sure where you're going with that. The lorry also hit her, not the other way round, so if anyone's getting points it should be the lorry driver.

Bit of a grey area there -

“Highway Code rule 268 advises against undertaking on a motorway: "Do not overtake on the left or move to a lane on your left to overtake". On other roads you can "only overtake on the left if the vehicle in front is signalling to turn right" (rule 163). On all roads, undertaking is permitted if the vehicles in the lane to the right are queueing and slow moving. Undertaking in an aggressive or reckless manner could be considered Careless Driving or more seriously Dangerous Driving, both of which are legally enforceable offences.”

That was my point. Also when entering a motorway you are supposed to give way if traffic is coming rather than force it into the middle lane.

Do we actually know who was changing lane at the time of the incident?

Having spent a few years in the 90s driving HGV's around the country when I saw the clip on the news saying he had been cleared of charges because he hadn’t see the car attached to the front of this tractor unit, I though boll*cks.

Ok then, her fault. All I saw in the article was that she had recently joined the motorway. I really depair at the lack of facts in reports. :x

He may have thought it was a large pot hole.

Now that's believable. :x

And with the state of the roads not impossible to get a jury to understand either.
