You'd have thought someone might have noticed. I can't imagine it went up over night? It says: "Helm Housing Association which owns the block, said it was told construction could begin in 2007" which raises the question, who told them? Seriously, I want to know! Are the planning department that bitter and twisted that they take pleasure from watching a million pounds of tax payer's money being spent and then ordering it destroyed, rather than handing the constructors a cease order before they'd built it? Maybe it was them that gave "permission" as some kind of sick joke? |

They probably assumed that it would get the nod through and in many situations retrospective planning permission is given at a later date. Though not in this case. |

Often in NI, certain pressures are brought to bear - remember the DUP deals with Gordon? Picture that sort of thing with Sinn Fein, though I've never seen it play out at such a local level, and such a level of cock-up... I'm guessing they'll compromise and the apartments will stand ![]() |

Yes but if they will not qualify for planning permission they will be setting a bad precedent in that anyone will then build and ignore planning permission and cite this case as precedent. In that case the buildings either should come down or the Housing association fined substantially, with the money going into council coffers for social housing. |

The 'bad precedent' was set long ago and is now a fine tradition ![]() Doing anything other than letting them stand will require even more questions to be answered, and you know how that goes... |

I still think a huge fine would stop the problem. A fine so big that they will never make a profit on the deal and use it as a basis to go after private contractors as well. |

I'd say it doesn't make much difference now, as common sense (or whatever you like to refer to it as) should prevail over the law/regulations at this point and in this case, but this type of issue should certainly not arise in the future if any lessons are learned here... |

From a green perspective they should not demolish the building but that just lets them off the hook. Hence the fine. In future to stop it they need building inspectors out to stop them before they have completed the building. They should be out there wandering the streets looking for developments and checking that they comply, and halting them if necessary. |

They can always apply for retrospective permission, but failing that tear the damn thing down, or else it will only encourage further non-compliance with the rules. |
