It still won't protect the developers and users from possible patent infringement.

The MPEG LA is already making noises about it violating the patent pool... Given that WebM is based on an older version of the MPEG format, it is possible that it is covered by patents in the pool. Once due diligence has been done and published, then I'll think about using it - it suffers from the same problems as Ogg at the moment, it is an idealist release, without taking into account the real world of patents... Just because it is open source doesn't mean it can't infringe patents.

Give me a due diligence declaration, combined with indemnity, and I'll seriously think about it.
