LOL! I'm surprised they weren't quoted "Section 44 of the anti-terrorism act". They could have been using the structure to hide nuclear weapons or something similar. |

To be honest there are portable gazebos as well. As long as it can be removed in a few minutes I would have thought common sense should prevail. Also as long as it does not impact on others. |

It may have damaged the ecology of the area. Windbreaks are a series of stakes get driven into the ground - if enough people do this, then the area could be damaged by having the ground punctured to a point where it gets even more fragile. I have no sympathy for the people with the windbreak. They clearly thought that it didn’t matter. |

Yes though how often does that happen? In areas of nature conservation I would agree, but it might even help soil drainage. Though signs would be necessary in such cases. Though how much damage can a windbreak do? I have seen far worse in the countryside such as dumped white appliances because of rules about recycling. Portable gazebos just rest on the ground so no penetration of the soil at all. Some element of common sense is necessary. |

ffs its a windbreaker! Damaging the ecology of the area? Give me a break. Its a huge grass field not an area of scientific interest. Not only that but the reason the council officials asked them to take it down was due to some bylaw about building structures. I'd have told them to get [LIFTED]. |

Damaging the environment? It is probably no more damaging than the driving across the Downs in a 4x4 that the council members did... |

I would say it would be considerably less damaging than a 4x4. |

What's the problem here? The local authority has used its powers and issued a by-law against semi-permanent structures. In the opinion of the officer, this included a windbreak. If you don't like it, complain to the council. If the council uphold the decision, vote for someone who will repeal the by-law. ![]() Of course they could also go for civil disobedience, but they shouldn't be surprised if they end up in court. |

Heavy handed extreme interpretation of a bylaw which potentially ruined a familys day out |

Have you ever met an over-zealous council official? |

How do you know it's extreme? Without looking at the by-law and the guidance issued by the authority on its enforcement I can't call it either way. It's equally likely that they were in fact breaking the by-law, which means they should take it down. |

A tent or gazebo could be classed as semi-permanent, as they could be up for a day or so, whereas a windbreak really is only as permanent as the person who is sheltering behind it. And if they still class them as 'semi-permanent' then they really need to make that clearer. And probably choose a more suitable phrase. |
