That sucks balls. Fact. But sometimes it is good to just get it out. I think you did that rather well.

I haven't lost a wife, but I'm starring down the barrel of a Christmas where I may lose my job and place to live. So whilst plenty of people *would* see it is as an opportunity, I wouldn't dare to offer such advice as I know just how bollocks it sounds at this stage.

Have you been paying 100% of the mortgage? If so, I can't see how she can possibly take the house in it's entire value. It would be different if there were kids involved. I hope you get some good advice on this, because it's obviously a big deal and a complicated legal situation.

I'd be also wanting to know if these debts are...

a) Unsecured, or secured on the house.
b) Just in her name, or both of you - obviously, if they're secured on the house then it involves you too.

Until you know this, I don't think you'll know exactly how much this will affect yourself.
If you're still on speaking terms with your wife (and frankly, I'd totally understand if not!) then it might be beneficial to sit down with her to discuss the exact nature of the debts and how much you're implicated. I'd try and do this before you get legal advice, as they will likely ask you these questions, so it may save having another costly meeting with the solicitor. legal types love to drag this out to a second or third meeting to earn more!

Advice is an odd thing. It may help to have experienced a similar thing yourself, but I don't think it is exclusive. Humour, sympathy, good and even bad advice can at least let a friend know you are thinking about them and offering support when it is needed.

We have a mortgage on the house at the minute that we'll not cover with the sale of the house given the current state of the housing market. I personally think there'll be a £50-60k shortfall.

All the debt is unsecured and separate from the house, which means that other than the mortgage, I have no other dealings regarding her debt.

To everyone else in this thread that has been kind enough to respond that I haven't name checked, thank you also.
As I said above, it's nice to have friends.

My condolences Mark, hearing other's problems often puts ones own into perspective. We are all somewhat lucky to have a community here that will listen to us, we are all here for you just as you have been here for us at times.

All I can say is that I hope that things go as smoothly as they can in such circumstances and that things are brighter on the other side.
