Bloody client - been two months late with paying an invoice which I have been chasing her about (apparently she’s changing bank accounts, etc). Cheque arrives today. She’s only gone and post dated it to Monday.

My bank isn’t a short distance away - it’s a long walk or a bus ride. Either way, tomorrow’s usual walk into town won’t include a cheque paying in session - but I’ll have to make a special journey during the week.

The thing is, my invoices carry electronic payment instructions - so it’s not she couldn’t have paid that way. Most clients do now.

She may have been making allowance for additional funds arriving.

That's her problem not Paul's and a pointless act apparently

wikipedia wrote:
In the United Kingdom post-dating a cheque carries no legal weight and therefore such a cheque can be cashed before the due date. However a bank can refuse to accept them if the post-date is spotted; if it isn't, the payer has no right to take any form of legal action against the bank for letting the cheque be processed.

There's no excuse for trying to load your inability to cover your debts onto someone else by writing a post-dated cheque. In fact, writing a cheque you know you don't have the funds to cover could technically be construed as fraud.

IMO Paul (admitting I don't know how lucrative this work is) I'd think twice before getting involved with said client in the future. I assume you're thinking that way anyway.

Yes but if it bounced because funds were not cleared in time then he gets a bank charge to pay. The numbers of people who are in serious financial trouble is large and increasing all the time.

Agreed, you may not get paid next time.

It lacks a mens rea if all they intended to do was delay the money going out and didn't think there was anything unusual in that behaviour.

I have done that loads of times. Dropped a cheque off after the banks shut on a Friday. Nothing illegal, just working the system to the limit.

I'll just leave this here.
If anyone can help me understand what that is, I'd be much obliged.
