Post subject:  A very highly valued customer

Had a call from Three today offering me a mobile phone for free on a contract.

I told him I was waiting for the next iPhone and wouldn't consider getting a phone until that comes out.

His reply was "ah, so you're waiting for the iPhone 5 that is coming out in December?".

It strikes me as odd that not only does he know what it is going to be called but also when it is being released. Considering that I'd guess that 95% of Apple's employees don't yet have that information I'd say he was making it up.

OK, I was pushing it a bit there but with the new iPad being called exactly that I don't think there is any certainty what the next iPhone will be called.

If you make it sound like you know all the details (because you're in the industry) and make it ages to wait for it then most people will take the phone & contract that's offered (thinking they can get the new item in December for Christmas).

Completely illegal though. Regulation 5 of the Consumer Protection from Unfair Trading Regulations 2008 states:

5.—(1) A commercial practice is a misleading action if it satisfies the conditions in either paragraph (2) or paragraph (3).
(2) A commercial practice satisfies the conditions of this paragraph—
(a)if it contains false information and is therefore untruthful in relation to any of the matters in paragraph (4) or if it or its overall presentation in any way deceives or is likely to deceive the average consumer in relation to any of the matters in that paragraph, even if the information is factually correct; and .
(b)it causes or is likely to cause the average consumer to take a transactional decision he would not have taken otherwise.


In other words if Three (or anyone else) tells you something that's false (or even present truthful information in a way that's misleading) and this causes you to make a purchase you would not otherwise have made, then they have broken the law.
