looks like i may very well be sacked next week ho hum as i will not do illegal placement of stock onto the shelves to ensure that the weekly check is passed (the mac) when i mean illegal i mean the repackaging of in-store pre-packed products in to bakery packaging and then the placement on the shelves for sale as fresh bakery goods/products passing this weekly check is vital for management to pass as it affects their annual bonus … |

Is there nobody you could complain to about this? You can't be penalised for refusing to do something illegal. As a last stop go for Trading Standards (especially if you do get the sack). |

Sounds like you are standing up for what you believe in, a good thing. I hope everything sorts itself out in a way that is best for you. Oh, and don't be quiet about it, but do stay in the proper channels, which is something I'd expect from you anyway. |

at this time i am awaiting a disciplinary which will take place sometime next week trading standards will be one port of call in the not to distant future but the management are all singing from the same song sheet and its going to be a bugger to prove … |

Well there will have to be a record of any proceedings so it will be interesting to see what 'the charge' will be. They'll have to trump something up by the sounds of things. |

Is it still the same company Steve? If so you may have to do what I did and take a negotiated settlement with them, legally you can't be sacked for "whistle blowing" so it may pay you to make a public disclosure before the disciplinary but knowing Tossco it won't make a halfpence of difference, they'll still sack you and then reach a breach of contract settlement which has the benefit of being tax free! The management will all be too far up the company to say anything against them but if you could get piccys then it would help, I doubt any of your colleagues will back you as they'll all be too scared of losing their jobs, the fear factor rules at the moment and certain large companies have more power and money than the government at the moment. |

not tesco TC but sainsburys i left tesco over a year ago and you are correct the management are sticking together like glue and everybody is scared of losing their job and i am most differently out on my own, ho hum … |

You have my admiration for sticking up for what is right. If only everyone would do the same... Good luck with the meeting. Are you entitled to take someone in with you? A witness might be useful if they're going to try and play games. |

Definitely worth recording the 'discussion' with management though if you can't film it. Be quite open about it, let them know you're not going to make it easy. |

Yes, you are always entitled to take someone with you into a disciplinary. They aren't allowed to comment, but are allowed to intervene in order to keep things on track. If, for example, the managers in this case mentioned that you have been late twice last week the person you take into the disciplinary can butt in and say that matter is nothing to do with the disciplinary. Obviously, they can make notes etc. |

I really hate that kind of abuse of authority and I sincerely hope you can get the better of them but, as you said, it's going to be a bugger to prove. If they do manage to edge you out and settle for breach of contract compensation, make sure you avoid any kind of gag order. A nicely worded email to the CEO, and possibly a call to the local rag, might just stuff up their bonuses good and proper. Don't get dropped in the sh!t without making a splash. |

QFT I'm not sure I'd have the confidence to suggest such things at what might feel rather like a criminal court, but stating your case clearly is the most important thing. I'm sure you'll be thinking about this a lot over the coming days, probably dreaming about it. They obviously know they are guilty, and they obviously love their annual bonus. That is going to be making them feel as uncomfortable as you, so remember you're right and they're wrong and don't let them forget it. |

i am an ex union rep so i have knowledge and experience with procedure (my appeal is already written ahead of any meeting that as yet has to happen) but this management team make the rules up as they go along and have done so for so long that its deemed as normal practice now this is an old management team within a new store example a baker was disciplined for not carrying out check weights of the freshly baked bread which is required by law and a big lecture was given to the whole bakery staff about the legalities which have to be maintained within the bakery then the very next day we are asked to do a 'botch' job so that the weekly check (the mac) for certain items can be passed this would require us to take stock from the shop floor open them and then repackage these items as in store bakery products for resale items such as cookies (packaged in the wrong bag and labelled as another type of cookie) scones (all types) apple turnovers repacking yesterdays uncut bread into new packaging and relabelling as fresh bread because the check is being carried out before the fresh bread is out of the ovens opening and repacking soft rolls into different sizes ie. 2x6 pack into 3x4 pack and then relabelling which can add upto 2 days extra life to that product the list goes on and on and on and if you don't comply you are not a 'team' player well it would seem i at this time am a team of one because i just will not do this not now not ever and i wonder if i was doing this and was caught how much support the management would provide me with its a upto £10,000 fine for the individual and dismissal for gross misconduct all for the management to get 4 and 5 figure sums as bonuses and no i am not quitting they are going to have too sack me … |

Citizens Advice Bureau is also a great place to get calling your employers tends to make them behave. Good luck. |
