I would have thought that if they make money from it they need to buy a licence to use the character. Fair use excludes commercial uses.

I would imagine that the reason is that paparazzi take photos of the person not the character created, though saying that, that could cover those candid shots taken on a set. Maybe the company dreaded the thought of a legal battle with the jackson family estate? Who probably want cash for the use of the zombie dancing michael look alike. Whereas a living person would probably take it as a compliment and let it pass.

But photographs of people can legally be taken in the street as a public area so can't be removed/deleted without the owner doing so Taking a very identifiable part of another medium (Michael Jackson in Thriller) and changing the format isn't fair game, although it is being suitably changed and is used in a slight parody so IMO it's not that bad, just like I think the Bob sleigh zombies would be Jamaican if they had the correct colours
