But how would one prove that it was for one of those reasons? Then how would one defend oneself?

You can't - certainly as the proprietor of a licensed drinking premises, you don't have to serve anyone you don't want to, and you don't need to supply a reason. Of course, if you do choose to supply a reason, you'd better be damn sure it's not 'because you are <insert sexuality of choice>', 'you are <insert race of choice>', 'you are <insert faith of choice>' because then that's discrimination.

Hence the court case and lawyers. You're right, they could have just refused to give them a room without stating a reason. I'm guessing they were told they couldn't have a double room but were offered a twin instead? Or something along those lines? When it gets to the court it's up to the lawyers to determine what "really happened". Without CCTV and sound covering the event there is no way of knowing what was said at the time.

James Woods starred in a TV show a couple years back that was canned called Shark. He played a former DA turned defence attorney and his catchphrase was, "Truth is relative - pick one that works". So true, and extremely apt here.

TBH I hope the case makes it all the way to the Supreme Court, we'll get a nice message and a precedent will be set then.

Binding precedents can only be set by the Court of Appeal or the Supreme Court.

Bring back the Law Lords!!!! We are not the USA or some piffling other country god damn it!!! <shakes fist> plusit sounds so much better when they use to say the LAW Lords have presided over a case. Bring imagary of some epic fantasy type, with maybe a dragon in the background and a heroic Palidin waiting to enact the judgement.

+1 It sounds so much better saying "The House of Lords ruled" rather than "The Supreme Court"...
