Well yes, but consumption in and enclosed area by one indivdual doesn't automatically put those around them at greater risk as a result.

Well fine. How's about (second hand) tobaco smoke measurably increases your individual risk of developing various forms of cancer as well as other diseases that have been medically attributed to smoking. Is that better for you?
