Section 5 of the Public Order Act 1986 strikes again. It's absurd that a Policeman can arrest you for using harsh language, sometimes "you're a [LIFTED] [LIFTED]" is the only language they understand.
Abolish it.

I disagree. Sure, it was abused in this case but that doesn't mean it always is.

There are times when it is valid but if the police go for the easy option and arrest home owners protecting their property they destroy the support of the public. The judge or magistrate should be able to award penalties against the police and CPS if they bring silly cases like this against innocent people. It would help restore public confidence and make them think twice about such cases.

There has been a report commissioned before (the name of which currently escapes me) that found the power is routinely abused. Perhaps one of the most famous examples is this: http://news.bbc.co.uk/1/hi/england/oxfo ... 606022.stmThe point of section 5 is to give the Police power to act when someone says something that does, or is likely to alarm or distress someone nearby, for example shouting anti-Semitic remarks in a Jewish area, making threats etc. Not only have the Police used the power when no-one is around to hear the remarks (thus it can't be likely to cause harassment, alarm or distress), but the Police have been ticked off by a Judge before for claiming it was they who suffered harassment, alarm or distress (which the Judge dismissed, stating that the nature of their role meant they would encounter harsh language and insults).
