So would you accept a job where you were told that breathing the air stood a higher than normal risk of giving you lung cancer and the employer would expect you to accept the risk? I think not. Yet this is what you would be expecting any bar staff to accept by re-instating smoking in pubs. I'm a Chemist (as in Chemistry not Pharmacy) by trade and I am also a COSHH assessor. Cigarette smoke would carry the risk phrase R45 - May Cause Cancer. As such it would have to be handled in a fume hood or other efficient extraction/containment system or I would have to wear appropriate breathing apparatus. My employer has a duty to either reorganise the work so it's not necessary to use the harmful substance (which is, in effect, what the smoking ban does) or provide the necessary PPE or workplace facilities to safely handle the hazardous material and minimise the risk as much as reasonably practicable. Second hand smoke kills, pure and simple (see Roy Castle). If an employer doesn't take reasonably practicable steps to minimise or totally eliminate this risk for their staff and patrons then they are derelict in their duty under H&S law.

My point is exactly that - it's my choice whether to accept the job or not. I probably wouldn't as smoke does no favours for my asthma.

Oh well, kiss goodbye to pubs then. They won't have any staff. Or rather, they would only have staff who were desperate, coerced or didn't understand what they were told in the first place. I like going to the pub but I'm not willing to inflict that on others just for my enjoyment (and we're back to why being allowed to smoke in pubs is selfish and anti-social  )

So should barbecued food, kippers, all alcoholic drinks, caffeinated drinks. I know so many people that complained quite loudly that until smoking was banned from Pubs they would not go. Once the ban came in they still stayed away.. go figure. My self personally I prefer pubs as they are. <edit> Back to the OP the guy is a first class thwonk. Deliberatly flouting the law, getting caught and fined and then not paying it..

Yes but the pubs once empty of smokers began to smell really bad. The smoke covered up a plethora of smells.

Stale beer/lager, sweat/body odour, really smelly farts, despair and depression You name it, cigarette smoke covered up the smell of it

"Safety" of your own home. Having worked in Frankfurt and having to spend one week sleeping in the "drug quarter" because of a trade fair booking out all the hotels, I can safely say that walking past pubs where people are sitting on the doorstep shooting themselves up is really not a good inducement to go and drink something in the establishment. As to smoking "other" substances, also no. I don't want to be affected by them, the same as I don't want to be affected by cigarette smoke. The town where my girlfriend lives has a Reggae Jam each summer. I went last year, but had to come home after a couple of hours, because I was feeling ill - it was an open air festival, but the amount of ganja smoke in the air was too much - the biggest problem I have with 2nd hand dope smoke is either I pass out or I get stomach cramps, depending on what exactly they are smoking. So giving up asthma attacks for unconsciousness isn't something I really want to do. I just want a nice night out with friends, without being made ill.

Both are illegal. Smoking is currently legal, though well on its way to becoming an ileagal substance. If it was legal to inject recreational drugs or smoke drugs then why not

OK I'm getting confused with the +1 -1 and the +1 agreeing with the -1..... I think he's a tool to be honest. A ban came in which he knew about and chose to ignore it and was thus fined. He has no one to blame but himself.

As for injecting drugs they probably already do that. As for smoking drugs that would be covered by the existing legislation as smoking.

I think in Holland you have the situation where smoking Grass in one of the "Cafes" is allowed BUT if you lite up a normal cigarett then you can be fined for breaking the smoking rules
