If Apple let people use the phones they've paid for how they want, this wouldn't be an issue.

It's always going to be an issue, since somebody will always want to do something with the device that the makers haven't anticipated or in fact is actually illegal (cf: modifying consoles like the PSP to play pirate games).

As to the initial story, I'm not in the least surprised. It's a device running the same OS as a device which has previously been hacked, what makes anyone think it wouldn't be vulnerable to the same exploits?

If so, for who?
If you jailbreak it and something nasty happens then you've got yourself to blame, not Apple.
If I buy a new car, then go about fitting a nitrous system that knackers the engine after 5 minutes, I wouldn't expect the manufacturer to honour any sort of warranty.

I would not bother jail breaking it. I am not happy about the lack of tethering, but can live with that.
