You need to draw comparisons to life in civi' street.
If a regular company employs a person to work nine 'till five with 28 days annual leave, the law demands that single mothers qualify for the job even if they take 50% of the working year off to look after their snotty nosed children.
Just because such a woman would be an obvious liability does not mean you can "discriminate" against her. Just because she might not turn up for duty at a critical moment does not mean you can discipline her. Just because she'll let you down time and time again does not mean you can judge her. Just because she's unfit to work does not mean you can employ someone better suited for the position.
That is the law.

That I believe is where the difference should be. We are not talking about a regular company and they did offer her a different job............

the armed forces is not a job its a profession that profession requires you to able and/or available for duty (any duty) at any notice, regardless …
if that is not to your requirements as a 'job' then you are in the wrong profession …

While I totally agree with you, I'm just pointing out that "equal rights" also screw employers and co-workers in civilian life. It's no surprise that someone might say "I can't go to the battle front today because little johnny has a runny nose - but I still expect the same rewards as the man that might die there today". While the law applies to one it has to apply to all. If the law is perverse you must still obey it. That is the nature of law. If you don't like it, change it - and good luck with that.

There has got to be a way that she can still serve though maybe in a different capacity? I do not think that it is racist in any way. Single mums have it tough at times but sometimes they do make things tougher for themselves.

It was offered, as per the article. She rejected the offer and chose to go for punitive damages instead. God bless her. She only wants the best for her little bastard...
