No, you only get the death penalty for actually killing people, strangely enough. What that guy did could go under a variety of offenses up to attempted murder but I doubt he'd get life, let alone The Long Walk.

I always meant to look it up, it was what 'capital crimes' extended to that I always wondered about as a result...
