Been there dude. No fun. Take care of yourselves and make sure you see a physio. Don't let the insurance fob you off with a cheque. Wait for a prognosis from the hospital before you think any more. When they give you exercises - do them. Lastly, the statutory max for "minor" injuries (not that it'll feel like that) is £2500. Get close to those with a settlement and that might help you fund your new car I don't agree with the principle, but everybody else does it, so fill your boots.

I agree with it when you're physicaly injured because of someone else being stupid.

More than likely, tempted to just ask them to pay for the cost of the damage. Well I will have missed a half day today + an important meeting because I cant drive there or really want to as a passenger given how I'm feeling. They should be happy they don't get charged the day rates for clients, 2 days off and it's more than the value of the car

You can claim on his insurance for whiplash as well, for the both of you. They will agree a settlement with you AFAIK.

At least it wont wipe out my no claims as it's not going to be a claim against my policy

This is what happened with me. I haggled for £2000 and an NDA preventing future claims. Got £1000 for the car and arranged to break it myself, making another £1000. Almost made the pain bearable and allowed me to get the Skoda and grow up a little bit. Do miss my Porsche rims and epic suspension though
