Isn't Android a Lunix variation? If so, aren't Google required by the license to release the software?

Theoretically, yes they are, but Google play fast and lose with the GPL.
They have never released the source code for a version of Android, until they are happy with it. They also don't let the community submit bug fixes and changes to the code. It has been a big argument between Google and the open source community for nearly a year, that they cannot get access to the current source code, just the last stable release. If they stay true to form, the 3.0 code appeared last week on the Xoom in the US, so the source code would, normally, appear in the public source tree in the next couple of weeks.
If they are waiting for it to work on 'phones as well, this could be delayed even longer.

Another article by Ars Technica here. An interesting point: So Google have rushed a product that has been long awaited? Why can I see some disappointed faces when these tablets are released?
