Yes but unlikely that he would win in this case. Trespassing and that well might not have been known about by anyone so unlikely to have been guarded against.

If he sues, he's very likely to win the case. Precedents have all ready been set. There was a hazard on the property that was not made safe, irrespective of whether the person falling foul of the hazard was there legally or not.

Who is to say that the well wasn't made safe. If it had been covered for many years without prior issue then that can be seen as reasonable protection. Someone jumping off a wall onto the cover, thereby breaking it and falling down the well, would probably be seen as an unforseen event and something that would not have to been protected against.

Either way this bloke is a tit and cases like this shouldn't even get to court.
