Might be hard

As the police say - its on his land and it could be difficult for a council to prove that you need planning permission for a bird box

It might be on his land, but it looks like it's crossing the boundary onto public property (over the footpath) and I think that's what'll do for it.

It’s attached to something in his land (a tree), but it’s most definitely across his boundary and in the public space.

Even if it is on his land and had planning permission, he could be forced to remove it if it was found to cause drivers to react in an unsafe manner.

But if it was found that a speed camera caused drivers to react in an unsafe manner that would open a massive can of worms...
