RMA, Distance Selling Act, Insufficient Product Info, etc...

So...

We have a number of very nice monitors from a large computer manufacturer.

Some of our staff wanted their monitors raised higher for comfort.

We bought some monitor arms supplied by (but not made by) said large computer manufacturer.

Said large computer manufacturer didn't give the greatest amount of product detail on their site.

We didn't verify the product particulars (although we could have) on the product manufacturer's website.

It turns out the monitor arms only add 1cm more lift to the standard stand of the large computer manufacturer's very nice monitors.

Said large computer manufacturer, (whose very nice monitors we had planned to use on said monitor arms) has said they'd not accept an RMA for 6 (unopened) units.

We think we're being hard done by.

Are we?

No, you don't. The DSR don't apply to business transactions (see here: http://www.businesslink.gov.uk/bdotg/ac ... =RESOURCES).

I suggest you look at the Business Protection from Misleading Marketing Regulations 2008 (Especially Regulation 3), it's the closest thing you'll have to recourse as a business, and even then only if the information provided was factually inaccurate or the overall presentation was misleading.

Contact your local Trading Standards office (at your local county/borough/unitary council) for advice. TBH if the supplier doesn't budge you'll probably end up in court .

Either way, I am vindicated!

It wasn't my call you see - "they" (some of my colleagues) bought the arms without consulting anyone who'd looked into them (ie. me) - had they done they'd have been pointed toward the next (taller) model up in the range, for 3/4 the price from another online retailer. Oh well, I was told the business account (with Dell) was "worth it".

I also advised we test them out straight away - but it was decided there was no rush (despite the fact we were getting them in response to workstation assessments made some 4 months ago!) :roll:

I then also demanded we intiate the return as soon as we found out they were a pointless waste of money (£10 a millimetre)

Did anyone listen to me? No. Oh well, my emails are all on record.

Still, £800 now down the drain. And it'll be up to me to set up the company eBay account no doubt. :x

Tomorrow I'm going see if I can "waste" £800 on 3D Connexion mice so I can get productivity gains up and mask what a stupid waste of money this has all been (and will continue to be as we're now going to have to buy more!) :roll:
