linkyIf you can be granted a patent and sue someone else for violation of it on the same day, how does that not fall under the definition of 'prior art'? Jon

And this is why the US patent system is seen as little more than a vague land grab to line lawyer's pockets on these sorts of law suits That said, Apple have done this before and still do it themselves http://www.talkandroid.com/69034-apple- ... -gestures/The design doesn't look much like they do either

TBF, Apple haven't actually done anything with that one yet as far as I know. So it's not exactly the same situation as above, although both do equally illustrate how utterly [LIFTED] the US patent system is. Jon

I know it's not the same, but it's the grab as many patents as possible that eliminates all creativity in case something infringes a patent, then only people like Apple could afford to fight the battle

Depends, if the patent has just been granted, it probably means the paperwork was filed 4 - 6 years ago...

1. Surely this is better than waiting years before jumping on lawsuit? 2. Is there no way the loophole could be closed to stop this kind of [LIFTED] happening.
Personally I think all lawyers are to$$ers but that's just my opinion.
