Not that anyone who wanted one couldn't just drive across to Belgium or France or Holland, buy a 3G iPad or iPhone 4, then just drive back into Germany and buy a 3G microsim to put in it. Oh no, that would be wrong.
Probably because the iPhone 4S wasn't launched, when the case was brought.

I'd imagine if BT want to 'realise the full value' of it's patent library, there are going to be a lot of mobile tech companies worried. BT have an extra-ordinary number of patents, at least in the EU. They've been doing comms research for something like 70 years, after all.
