When the best defense you can muster to justify why you did something is "well it's not against the law", one must ask oneself serious questions.

In his case about taking a long walk off a short pier.

I might also suggest that English Law has long-subscribed to the concept of negative liberty, i.e. unless an activity is specifically prohibited by law then it's perfectly legal.
