That's not how the system works.

I always thought that you applied for a patent, you could put patent pending on the product but until the patent had been approved you could not use it for suing others. The patent would not be granted until it had gone through the new and different clauses of patent law. Then you would have the patent. Which was defendable in court. None of this crap rushing it through because we are too lazy to check it.
