No, what I meant was I buy an OS - or licence to use an OS - but I'm outside the jurisdiction of the US federal law. If I then decide to use that OS for nefarious purposes, how can the US law apply to me? Or do the Feds go after MS, Apple, Google, et al, because they can't legally drone me? Ah, hang on a minute...

Microsoft can't sell you Windows 8 unless you agree not to use it to develop nuclear weapons.
If you lie by ticking the agreement and then breaking your promise, then Microsoft could get very cross at you. They might possibly even sending a strongly worded solicitors letter. The agreement you "signed" should be enforceable in most countries, at least in part.
It's probably also best to turn off Windows Updates if this applies to you, although there is no evidence of them remotely disabling a paid for OS in the past. Well, not exactly. Kind of, but that was a bit of a cock-up really.
I imagine with trade embargo now in place, activating Windows from a North Korean IP address might get tricky. I am sure this, along with the fear of stern words, will devastate their plans for nuclear supremacy and world domination.

Assuming they are as incompetent as we all joke about and don't know how to set up a proxy or VPN to another country. Couldn't Tor be used for something like this?

I was joking. Being practical though, it's not entirely trivial to use TOR on a machine where the OS isn't enabled. You'd have to configure another box as a gateway. The same goes for VPN, although far more routers can run regular VPNs than TOR so using off the shelf solutions would be easier. Either solution is easier than creating a fission chain reaction. They might also need a valid credit card not registered to an address in NK or Cuba. I'd love to hear a recording of the alleged support calls to Microsoft...
