Intent in legal terms is premeditation. There was none of that.

PERMENANTLY I said. He's alright now isn't he? The guy needs a break. Sure he injured the kid and he's admitted it, but manslaughter or attempted murder - [LIFTED] off. Those kids need to learn a lesson here. The guy lost it and I already said there's no excuse, but the pressure these guys are under is immense. I've worked in classrooms with 6 and 7 olds and that's intense, teenagers are likely to be way worse.

Right, so if someone winds you up enough you'll cave their head in with a barbell?

If you stoved in a childs face I'm sure everyone would understand...

No, they wouldn't. But the guy had a [LIFTED] breakdown. As a result of a pre-existing stress condition and the bullying of the kids. Should he have hit the kid? Of course not. But everyone needs to take a breath. GBH sure, but the rest is just bollocks.

im still curious as to why they let people (not just this guy) with stress problems teach, its a stressful job as it is. how could no-one have seen something like this coming?

Probably. But you can't predict the kids. Bearing in mind he'd just returned, he was at his most vulnerable. Had he settled in for a a little while, he might've handled it better. Who knows?

Every teacher I know (and that's quite a few from NQT to 20yrs experience) has had issues with stress at some point. I think it's the nature of the system as it is. It's unfortunate and probably avoidable, but I don't have the answers.

It just seems to be that in this case, he's pleaded for GBH and he should get GBH - nothing more.

Probably forced to return to work or get the sack?

Ah, that clears up your point. When you said 'those kids need to learn a lesson here' I was unsure as to your stance.

If he had an underlying stress condition and left because he thought he may harm somebody the Education Authority, at the very least, should have referred him to a Clinical Psychologist.

Sorry, it needed clarifying. There are clearly lessons to learn here, but I think the defendant has already learnt his!

Quote:
Nottinghamshire school 'attack' teacher acquitted
A teacher who struck a pupil with a dumbbell has been acquitted of attempted murder and causing grievous bodily harm with intent.

Peter Harvey, 50, hit the 14-year-old with a 3kg (6.6lb) weight at All Saints' Roman Catholic School, Mansfield, in July 2009, a jury heard.

The boy, who said he could not recall the attack, suffered a fractured skull.

Mr Harvey had returned to work after being signed off with depression and stress for several months.

But the court heard he had been mocked by pupils moments before the attack.

He had denied attempted murder and causing grievous bodily harm with intent, but admitted a charge of causing grievous bodily harm.

That sounds about the right result to me. Quick decision by the jury as well.

+1 It is good to see that the jury realises that pupils can be awful. I would have had no problems acquitting. The provocation was incredible, on top of his previous condition. I hope that the judge gives him a suspended sentence for the GBH. Custody is not warranted in this case.

He spent eight months on remand so the judge has said that was more than enough so when he is sentence from the GBH he will go free.
