Just to reinterate as someone in Las Vegas is asking me... if a pie has a pastry base but not a top it is still a pie?

No, it's an abomination. How can it be a pie without a pastry top? It either has to be fully eclosed with pastry, or be in a dish where the pastry completely covers the filling so none of the filling is exposed.
